Terms & Conditions

These Terms & Conditions ("Terms") are an agreement between you and Zardsoft, MB, a company established in the Republic of Lithuania ("ZardForge", "we", "us", or "our"), governing your use of the ZardForge website and studio — AI 2D game-asset generation, the browser-based editor, and sprite-sheet export (the "Service"). Please read them together with our Privacy Policy.
1. Acceptance & eligibility
By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a company or other organization, you confirm you are authorized to bind it, and "you" includes that organization.
- You need an account to use the Service.
- You must be at least 16 years old (or the minimum age required in your country to consent to online services).
- If you do not agree to these Terms, do not use the Service.
2. The Service
The Service lets you, among other things:
- Generate 2D game assets from text prompts and reference images using an AI image model.
- Edit assets in a browser-based, layered editor (brushes, masks, blend modes, adjustments, AI object replace, and similar tools).
- Export assets, including sprite sheets / texture atlases with atlas metadata, background removal, trimming, upscaling, and related export features.
- Collaborate in shared workspaces, where that feature is available (presence, comments, team membership).
We may add, change, or remove features over time to improve the Service.
3. Accounts & security
- You are responsible for your account and for keeping your credentials confidential. Activity under your account is your responsibility.
- We may require you to verify your email address before using certain features.
- You can sign in with email and password or via Google or Facebook OAuth. Your use of those sign-in methods is also subject to the providers' own terms.
- Notify us promptly at privacy@zardforge.com if you suspect unauthorized use of your account.
4. Subscriptions, billing & taxes
- Paid plans are billed through Stripe, our payment processor. By subscribing you authorize the applicable recurring charges.
- Any prices shown on the site are indicative. The final price, currency, billing period, and applicable VAT are confirmed at checkout.
- VAT is applied according to EU and Lithuanian rules. In plain terms: for consumers (B2C) we generally charge VAT based on your country (handled via the EU One-Stop-Shop scheme), and for consumers in Lithuania this is standard Lithuanian VAT; for businesses (B2B) in another EU country that give us a valid VAT number, the reverse-charge mechanism normally applies; and for business customers outside the EU, the supply is generally outside the scope of EU VAT. The correct treatment is determined at checkout.
- We issue the invoice for your subscription as the seller.
- Subscriptions renew automatically for a further period of the same length at the end of each billing period, and your payment method is charged on each renewal date, until you cancel. Unless we notify you of a price change in advance, the then-current price for your plan applies on renewal. You can cancel at any time before the next renewal from your account settings; cancellation stops future renewals and your access continues until the end of the period you have already paid for (see Cancellation & refunds).

- The Service is a digital service supplied over time. Except where the law requires otherwise, fees already paid for the current period are non-refundable.
- Consumers in the EU have a 14-day right of withdrawal for digital services. At checkout you can give your express, prior consent for us to begin supplying the service immediately and acknowledge that, once supply has begun, you lose your right of withdrawal. We will confirm that consent and acknowledgement on a durable medium (for example, by email). If you do not give that consent, supply begins after the 14-day period ends.

Nothing in this section limits your mandatory statutory consumer rights.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or to create illegal content.
- Submit prompts or content that infringe the intellectual-property, privacy, or other rights of any third party.
- Generate content that violates the policies of the underlying AI provider.
- Abuse, scrape, overload, reverse-engineer, or attempt to circumvent the security or rate limits of the Service.
- Resell, sublicense, or provide the Service itself to third parties except as expressly permitted.
We may apply reasonable rate limits and usage limits, and we may suspend or remove content or access that violates these Terms.
7. Intellectual property
Our platform
ZardForge and its licensors own the Service, including the software, editor, interface, branding, and all related intellectual property. These Terms do not transfer any of those rights to you.
Your assets
As between you and us, you own — or to the maximum extent permitted by law are granted all rights in — the assets you generate, edit, and upload using the Service ("Your Content"), subject to your payment obligations and these Terms.
A note on AI-generated output
The copyright status of AI-generated output is uncertain and may be limited or unavailable under the law of some countries. We make no promise about the copyrightability or exclusivity of AI-generated output. You are responsible for ensuring that your prompts, reference images, and your use of generated assets do not infringe the rights of any third party.
License you grant to us
To operate the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, and display Your Content solely to provide and maintain the Service for you (for example, to store your projects, run generation and editing, and produce exports). This license ends when you delete the content or your account, except for backups or records we must retain by law.
8. Third-party services
The Service relies on third parties — including Google and Facebook (sign-in), Stripe (payments), and the AI image-model provider (Google Gemini / "Nano Banana", via Google AI Studio or Google Cloud Vertex AI). Your use of those features is also governed by the relevant third party's terms and policies. We are not responsible for third-party services we do not control.
9. Warranties disclaimer & limitation of liability
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, non-infringement, or that generation results will meet your expectations or be error-free.
To the maximum extent permitted by law, ZardForge will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the liability.
Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for fraud, gross negligence, death or personal injury, or your mandatory statutory consumer rights — which remain unaffected.
10. Termination & suspension
- You may stop using the Service and delete your account at any time.
- We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service and other users. Where reasonable and lawful, we will give notice.
- On termination, your right to use the Service ends. Provisions that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) continue to apply.
11. Governing law & disputes
These Terms are governed by the laws of the Republic of Lithuania, without regard to conflict-of-laws rules. Disputes are subject to the jurisdiction of the competent Lithuanian courts.
If you are a consumer, this choice of law and jurisdiction does not deprive you of the protection of the mandatory consumer-protection rules of your country of residence. If we cannot resolve a dispute directly, you may refer it to a competent alternative dispute resolution (ADR) body in your country of residence. In Lithuania, the competent authority is the State Consumer Rights Protection Authority (Valstybinė vartotojų teisių apsaugos tarnyba), vvtat.lt (opens in new tab).
12. Changes to these Terms & contact
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Continuing to use the Service after changes take effect means you accept the updated Terms.
